Introduction and Acceptance of Terms

Welcome to Party Leader (the “Platform”). These Terms and Conditions (“Terms”) govern your access to and use of the Party Leader website and services. By accessing, browsing, or using our Platform to book or list an event, you (“User”) acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy provisions outlined herein. If you do not agree to all of these Terms, you must refrain from using our Platform.

By using the Platform, you affirm that you are at least 18 years old (or the age of legal majority in your jurisdiction) and capable of entering into a binding contract.

These Terms constitute a legal agreement between you and the operator of Party Leader (the “Operator”, “we”, “us”, or “our”), who is an individual based in Milan, Italy.

We may update or modify these Terms from time to time. The latest version will be posted on this page with a new “Last Updated” date. Continued use of the Platform after any changes signifies your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

Scope of Service – Platform Nature and Disclaimer of Agency

Party Leader is an online marketplace and matching service that connects solo travelers and users with independent third-party event hosts, known on our Platform as “Party Leaders” (the “Hosts”). We allow Hosts to list local food, drink, and party experiences (“Events”), and users to discover and book these Events. Important:

Not a Travel Agency or Tour Operator: We do not create, own, or operate any Events.
No Agency or Employment: Hosts are independent; there is no employment, agency, or partnership between Hosts and Party Leader.
Direct Contract: When you book, you contract directly with the Host—Party Leader is not a party to that contract.
Host Responsibility: Hosts must comply with all local laws and licensing for their Events. We make no guarantees.

By using the Platform, you acknowledge Party Leader’s sole role as an intermediary connecting Users and Hosts.

User Account Registration

To book an Event or use certain features, you may need to create an account. You agree to:

Provide accurate, current, complete information (name, contact, payment).
Keep your login credentials secure; notify us of unauthorized use.
Be at least 18 years old (or legal age in your jurisdiction).
Maintain only one account and not transfer it.

We may suspend or terminate accounts for violations or suspected fraud.

Booking Process and Payment Terms

Select an Event: Each listing shows Host-provided description, date/time, inclusions, total price, and booking fee.
Booking Fee: You pay a small upfront fee (via PayPal or bank transfer) to reserve your spot. This fee is non-refundable once confirmed (see Cancellation below).
Confirmation: After fee payment and Host acceptance, you receive confirmation and are added to a WhatsApp group with other participants.
Remaining Balance: You pay the Host directly the remaining amount (total price minus booking fee). Party Leader does not process this payment.

Pricing & Currency: All fees are in Euro (€). Any bank or conversion fees are your responsibility. Hosts set the final balance and handle any applicable taxes.

Cancellation and Refund Policy

User Cancellations: Booking fees are non-refundable once your booking is confirmed (including no-shows).
Host-Initiated Cancellations: If a Host cancels or reschedules, you receive a full refund of your booking fee. You may apply it to a rescheduled date if you agree.
Minimum Participants: If an Event is cancelled due to insufficient sign-ups, you get a full fee refund.
Platform Cancellations: In rare cases, we may cancel for safety/fraud reasons—full refund of your fee.
No Refunds on Direct Payments: Any payments you make outside the Platform (to the Host) follow the Host’s own refund policy.

Chargebacks to circumvent these rules may lead to account termination.

User Responsibilities and Conduct

You must:

Treat Hosts and other participants with respect; no harassment, hate speech, or violence.
Follow Host instructions and local laws (e.g., age limits, venue rules).
Not solicit Hosts or participants to book off-platform.
Behave safely and responsibly; inform Hosts of any health restrictions.
Use the Platform legally; no fraud or illicit activities.
Not record or broadcast Events for commercial use without permission.

Violations can result in removal from Events, no refund, and account suspension.

Independent Third-Party Hosts (Party Leaders)

Content Accuracy: Hosts provide all listing details. We do not verify or guarantee their accuracy.
Host Performance: Hosts are solely responsible for quality, safety, and delivery of Events.
Liability: Party Leader is not liable for any acts or omissions of Hosts or participants.
No Endorsement: Listing ≠ endorsement. Conduct your own due diligence.
Release: Any legal claims about a Host’s actions must be brought against the Host, not Party Leader.

Limitation of Liability and Disclaimers

Use at Your Own Risk: The Platform is provided “as is.” We make no warranties about availability, accuracy, or safety.

No Liability for Events: We are not responsible for injuries, losses, or damages from any Event or participant conduct.

Assumption of Risk: You assume all risks of attending Events, including health, safety, and logistical risks. We encourage personal insurance.

Third-Party Services: We do not control services like PayPal or WhatsApp and bear no liability for their faults.

Cap on Liability: Our maximum liability is limited to the booking fees you paid in the 12 months before a claim (or the fee for the specific Event).

Indemnification

You agree to indemnify and hold harmless Party Leader and its Operator for any claims, losses, or expenses arising from your breach of these Terms or misconduct at an Event, including legal fees.

Privacy and Data Protection

We process your personal data in compliance with GDPR:

Data Collected: Name, email, WhatsApp number, payment info, usage data.
Purpose: Booking facilitation, communications, support, optional marketing.
Sharing: With Hosts (to add you to WhatsApp groups) and trusted service providers.
Retention: Kept as needed for service and legal requirements.
Your Rights: Access, correction, deletion, portability, objection. Contact us to exercise them.
Security: Reasonable measures taken, but no absolute guarantee.
WhatsApp Groups: Your number is shared with group participants—use WhatsApp responsibly.

Intellectual Property Rights

License: You get a limited, revocable license to view and use content non-commercially.
Trademark: “Party Leader” and logos are our trademarks. No unauthorized use.
User Content: Uploading gives us a royalty-free license to operate, promote, and improve the Platform.
Third-Party IP: Respect others’ IP; infringement may lead to account termination.

Termination of Use

By You: You can delete your account by contacting us, but paid bookings remain subject to these Terms.
By Us: We may suspend or terminate access for violations or legal reasons, with or without notice.
Survival: Obligations like payment, liability limits, and indemnification survive termination.

Modifications and Entire Agreement

Service Changes: We may add/remove features or suspend the Platform; we honor existing bookings or refund fees.
Terms Changes: Material updates will be notified, but continued use = acceptance.
Entire Agreement: These Terms (plus Privacy Policy) are the full agreement.
Severability & No Waiver: Invalid provisions are severed; failing to enforce a right is not a waiver.
Assignment: You may not assign; we may (e.g. in a merger).

Governing Law and Jurisdiction

These Terms are governed by the laws of Italy.

Jurisdiction: Exclusive courts in Milan, Italy, except where consumer law provides otherwise.
Dispute Resolution: Please contact us first; class actions are waived where permitted.
